MiniFriend Rewards Terms & Conditions
Terms Effective: August 1, 2024
MINISO CANADA (“MINISO”, “we”) grants you access to the MiniFriends (“MINISO”) Rewards program (“Program”), conditioned on your acceptance of the terms, conditions, and notices contained herein (“Terms and Conditions”). These Terms and Conditions do not apply to any other websites, services, or programs offered by us. Through your participation in MINISO Rewards, you are expressly agreeing to comply with these Terms and Conditions.
You are also subject to the MINISO Privacy Policy. You agree that MINISO may amend these Terms and Conditions and the Privacy Policy at any time by posting the new terms and conditions on our website. Through your participation in the membership program, you waive any rights you may have to specific notice of such amendments, should they occur. In the event of any amendments to these Terms and Conditions, your continued participation in the Program signifies your acceptance of the amended Terms and Conditions. We encourage you to review these Terms and Conditions frequently to thoroughly understand our policies.
Membership & Eligibility
MINISO Rewards is a free rewards program offered by MINISO offered to customers located in Canada. Membership in the Program (“Membership”) is limited to individuals only and limited to one account per individual. No purchase is necessary to become a member of MINISO Rewards. The membership program is intended for personal, non-commercial use only. You must be age 15 years or older to be eligible for membership. Eligible minors must obtain their parent’s or legal guardian’s consent prior to participation. Your parent or legal guardian must agree to be bound by and is in compliance with these Terms and Conditions. By being in the Program, you certify that you are at least 15 years old. Additionally, participants in the Program must: (1) have a valid Canadian mobile phone number. (2) have an active, valid E-mail address; and (3) be a natural person. Corporations, groups, and other business entities are not eligible to participate nor are technological beings or entities, regardless of their definition under common law.
You may not use the Program for any purpose that intentionally or unintentionally violates these Terms and Conditions, be it in letter or spirit. This includes but is not limited to any actions that: a) may result in damage to the Program or MINISO; (b) is defamatory, abusive, obscene, suggestive, harassing, threatening, inflammatory, fraudulent, or similarly unacceptable; (c) is linked to the commercial resale of MINISO products without explicit prior written consent from MINISO; and (d) attempts to or actually interrupts the operations of the Program or MINISO business. Additionally, you may not use the Program in any way that violates applicable laws, causes damage to any third party and/or infringes on the rights of any third party. You agree to defend, indemnify and hold on to the rights of any third party. You agree to defend, indemnify and hold MINISO, its vendors and service providers, and each of their respective affiliates and employees harmless from and against any actual or threatened demands of any kind or nature arising out of or in connection with your violation of these Terms and Conditions.
Joining the Program
You may join the Program by creating an account through our website here. Personal information such as your name, phone number, E-mail address and birthday are required upon registration. You can also update your personal information through this website at any time. Your member account pertains uniquely to you; it may not be sold, transferred, shared with or assigned to any other party, nor can it be used by you for commercial purposes of any nature. You may not maintain more than one member account; in other words, every person is limited to one member account.
MiniPoints
The benefits offered through the Program are based on “MiniPoints” you earn and a number of special promotions (which can come with their own separate and/or additional terms and conditions). All stores will be able to collect and redeem points except Polo Park in Manitoba, Quebec, Saskatchewan and Yellowknife.
We may offer bonus points events from time to time, and in such circumstances, the bonus points offer would apply. Separate terms and conditions may apply to each bonus point offered.
At the time of checkout, you must provide our staff with your MiniFriend registered phone number, email address, or digital MiniFriend membership number to have any MiniPoints credited to your account.
You will earn MiniPoints based on the value of your purchase at the rate of 1 MiniPoint for each whole dollar ($1.00) of your transaction before tax at participating MINISO locations. For example, a purchase of $5.50 before tax will earn you 5 points. Fractional amounts are not stored in the system nor are they added to subsequent purchase. A qualifying transaction will only earn points for the member account associated with the registered phone number or email address presented at the time of purchase. Points cannot be combined or shared among other member accounts.
When a transaction that accumulated points to your account is returned or voided, MINISO will deduct the applicable MiniPoints from your account balance. Purchases that received discounts from MiniPoints redemption must be returned in full, partial returns will not be accepted. In the event that the number of MiniPoints deducted is equal to or greater than the number of points in your account, the point balance will return to zero.
MiniPoints themselves have no cash value and can only be redeemed for Rewards, as defined below. MINISO may, in its sole discretion, allow members to be redeemed for benefits or items of merchandise from time to time. However, unless expressly permitted by MINISO, MiniPoints are never redeemed for cash, for another product, or vouchers.
From time to time, MINISO or others acting with our permission may offer special promotions that allow Program members to earn points faster. Examples of such special promotions may include, but are not limited to, “Double-Points Days”, “Double Point Items”, and “Triple - Point Items.” MINISO, in its sole and absolute discretion, may also offer opportunities to earn points without first requiring purchase of MINISO items. Examples of such opportunities include, but are not limited to, points earned from the sign-up bonus, MiniPoint giveaways. MiniPoints will be awarded according to the description and/or terms and conditions set forth in the respective promotional offer.
Reward Redemption
As part of the benefits of being a member, your MiniPoints may be redeemed for rewards (“Rewards”). Reward availability is determined by MINISO at its sole and absolute discretion. Every 60 points equals to $1 in discount, applicable towards your purchase total after tax. You are eligible to redeem MiniPoints for a Reward only if you have 60 or more MiniPoints in your account. When redeeming MiniPoints for discounts (in terms of dollars off) on purchases, the redeemed amount is applied after tax. For example, on a purchase total of $5.95, 120 MiniPoints (valued at $2) may be redeemed towards the purchase. Rewards can only be redeemed in store at participating MINISO locations. Reward redemption is also subject to availability of supplies. Substitutions may be made by MINISO in its sole and absolute discretion. The value of points is also subject to change, at Miniso’s sole and absolute discretion. MiniPoints can be redeemed starting from the next day such points were earned, which means that you cannot redeem the points on the day that you earned them.
To redeem a Reward, members must provide in-store staff with the necessary account information (phone number) and inform them of the desired Reward. You cannot redeem more than $50 within one transaction. Each time you redeem a Reward, MINISO will remove the corresponding amount of MiniPoints from your account.
Points have no actual cash value and cannot be transferred or sold, and can only be exchanged for rewards. If a particular Reward is not fully used when redeemed, the remaining balance of the Reward will not be refunded. MiniPoints are deducted at time of reward exchange. MiniPoints follows the same return and exchange policy in store. For returned item that payment is made with MiniPoints, Miniso will reimburse your MiniPoints back to your MiniFriend account. For MiniPoints earned by returned item, Miniso will deduct the MiniPoints accordingly from your account. If your remaining MiniPoints is less than deduct MiniPoints, the balance will show negative MiniPoints.
These Terms and Conditions apply to any and all Rewards given through MINISO Rewards. Each Reward may be subject to additional terms and conditions of the particular promotion.
Expiration
Every MiniPoint will be expired in 12 months from the date you earn it. To clarify, if you earn 10 points on August 1st, 2024, and you don’t redeem them on or before July 31st, 2025, at 23:59 PM Pacific Time (Vancouver time), they will be expired and cannot be redeemed with other points later. If you feel your MiniPoints have expired in error, please email us at customerservice@miniso.ca for assistance.
Points Reset
On July 31st, 2024, at 12:00 AM Pacific Time (Vancouver time), all member points earned prior to this date will be reset.
Special Promotions
MINISO may, at its own discretion, launch special promotional offers and activities via MINISO Rewards. Such special promotions will be subjected to these Terms and Conditions as well as additional terms and conditions. Special promotions may or may not be distributed to the entire membership program base. MINISO reserves the right to target specific members for eligibility to receive any special promotional offers.
Consent to Third Party Content and Terms
Via the membership webpage, MINISO may provide or require access to third-party content, links to web pages, and any embedded content contained therein. We may also use the services of third parties to make portions of the membership program available to you. The terms and conditions of the respective third-party sites govern your visit to and use of such sites, regardless of having attained access to them via the website or the membership program and including any situations where your membership information is made available to these sites through their access. It is your sole responsibility to determine when you are accessing third-party content or services. MINISO’s provision of any third-party content does not signify endorsement of such content or affiliation with the third party, nor does MINISO make any guarantee of its accuracy, completeness, reliability or suitability. Your participation in the Program signifies agreement that you will not hold MINISO responsible or liable in any manner for any third-party content or services.
Privacy Policy
MINISO takes your privacy seriously. We also highly encourage you to review our Privacy Policy. Your participation in the membership program signifies your acknowledgement and acceptance of the terms contained in the Privacy Policy. MINISO retains the right to update, at its sole discretion, the content, terms, conditions, policies, and practices contained within the Privacy Policy; all updated versions will become effective upon publishing and will contain their date of publishing for your reference.
Program Opt Out
Members of MINISO Rewards may opt out of the membership program by contacting MINISO at customerservice@miniso.ca. Once a member has opted out of the membership program, such member may not earn additional MiniPoints in his or her member account. The available MiniPoints balance and outstanding Rewards in the member account will expire immediately, not to be reinstituted should the account be reopened.
To protect your privacy, the account information will be deleted upon opting out of the membership program. If you decide to re-open the membership account, you will have to provide all necessary information again, and earn point balance from zero.
Changes, Termination and/or Removal from Program
MINISO may, in its sole discretion, alter, limit, or modify the Program rules, regulations, benefits, Rewards eligibility for Membership, or any other feature of the Program (including assigning any of its obligations to customers under the Membership at any time to another person or entity, without recourse) or may terminate the Program any time at its sole discretion, by posting any such changes on the MINISO CANADA website. Where required by law, MINISO will send you a written notice of these changes, not more than 90 days and at least 60 days prior to the effective date of the change, setting out the amended terms and the date of the coming into force of the amendment.
YOUR CONTINUED PARTICIPATION IN THE PROGRAM FOLLOWING SUCH CHANGES CONSTITUTES YOUR ACCEPTANCE OF ANY AND ALL CHANGES.
MINISO reserves the right to exclude individuals from the Program or remove MiniPoints from a member’s account in its sole but reasonable discretion. In particular, any abuse, manipulation or “gaming” of the Program or its rules (as determined by MINISO), failure to follow any terms of the Program, any misrepresentation or any conduct detrimental to the interests of MINISO not otherwise protected by law may subject members to Membership revocation or deduction of MiniPoints obtained through these abusive or manipulative activities and will affect eligibility for further participation in the Program. Membership is non-transferable and Membership purchases must be made by the member. If your Membership is revoked or otherwise cancelled, any MiniPoints in your account will automatically expire. MINISO reserves the right to make changes on its Website and these Terms at any time. It is your responsibility to check or review these Terms from time to time to keep informed of any changes. By joining the Program, you hereby agree to be bound by any such changed Terms.
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, MINISO AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING OUT OF OR IN CONNECTION WITH YOUR PARTICIPATION OR MEMBERSHIP IN THE PROGRAM. INCLUDING DAMAGES ARISING OUT OF CHANGES TO OR TERMINATION OF THE PROGRAM. THIS IS A COMPREHENSIVE LIMITATION OF LIABILITY THAT APPLIES TO ALL DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, PUNITIVE OR CONSEQUENTIAL DAMAGES, LOSS OF DATA, INCOME OR PROFIT, LOSS OF DAMAGE TO PROPERTY AND CLAIMS OF THIRD PARTIES. TO THE EXTENT PERMITTED BY LAW, THE LIMITATIONS ON MINISO’S LIABILITY SET FORTH HEREIN SHALL APPLY WHETHER FOR BREACH OR REPUDIATION OF CONTRACT, OR WHETHER IN TORT, CIVIL LIABILITY BY WAY OF NEGLIGENCE, GROSS NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. BY AGREEING TO THESE TERMS, YOU WILLINGLY AGREE THAT YOU HAVE RELINQUISHED YOUR RIGHT TO SEEK THESE DAMAGES FROM MINISO AND THAT IS A REASONABLE ALLOCATION OF RISK.
Resolving Disputes
If a dispute should arise between you and MINISO, we want to provide you with a resolution that is efficient and cost effective. In our experience, almost all customer service disputes can be resolved to your satisfaction by our customer service team, reachable by emailing customerservice@miniso.ca.
If your dispute cannot be resolved using our customer service team. These Terms describe how we shall proceed with the resolution of the dispute.
TO THE EXTENT PERMITTED BY APPLICABLE LAWS, YOU AND MINISO AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE PROGRAM MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACQUIRES. OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED.
NO CLASS ACTIONS: You may only resolve disputes with us on an individual basis and may not bring a claim as a plaintiff or a class member in a class, consolidated, or representative action. Class arbitrations, class actions, private attorney general actions, and consolidation with other arbitrations are not allowed.
Choice of Law/Forum Selection
These terms and conditions shall be governed by the laws of the Province of Ontario and the laws of Canada applicable therein, and all Members attorn to the jurisdiction of the Province of Ontario.
General Information
In the event that any portion of these Terms and Conditions is deemed unlawful, void or unenforceable, then it will be deemed severable from these Terms and Conditions and excluded, with no impact whatsoever to the validity and enforcement of remaining portions. Your rights and/or obligations may not be transferred in any way under these Terms and Conditions. All of MINISO rights and obligations under these Terms and Conditions are freely assignable for any reason, including without limitation, in connection with a merger, acquisition, sale of assets, by operation of law or otherwise. Headings and titles in these Terms and Conditions are provided only for convenience and shall not in any way affect the meaning or scope of any portion of these Terms and Conditions.
